Prof Makau Mutua condemns High Court ruling on gay sex

Prof Makau Mutua has condemned the decision of the High Court upholding the ban on gay sex.

On his Twitter page Mutua said judges did not understand the law, facts and science concerning homosexuality.

He urged the Court of Appeal to reverse this decision.

In Kenya, gay sex is punishable by 14-years in jail.

The National Gay and Lesbian Human Rights Commission (NGLHRC) had petitioned the court to repeal this section of the constitution.

According to NGLHRC the section is a colonial era penal code that does not stand for equality and dignity of every Kenyan.

However on Friday the High Court did not agree with the NGLHRC and ruled that according to the Penal Code homosexuality is illegal.
