A high court has found guilty of murder a person who is said to have killed his colleague in Marsabit after being irritated by the way he chewed miraa.
The Marsabit court had previously convicted Abu Ali of manslaughter on June 25 after he killed Wario Halake by slashing his head as they were grazing cattle.
According to the high court, the first prosecution had not proved the charge of murder against the accused beyond reasonable doubt.
The court has declared that it is satisfied that the accused caused the death of the deceased because his injuries resulted from an assault.
“I’m further satisfied that it is the accused who inflicted the fatal injuries on the deceased. The accused defense does not raise any doubt on the prosecution evidence,” the judge ruled.
