Samburu Governor Moses Kasaine has been warned by against accessing his office without the permission of the Ethics and Anti-Corruption.
This is after Justice Mumbi Ngugi ruled that office holders charged corruption should not be allowed to access their office.
Earlier on it was not illegal for state officers charged with abuse of office to gain access to their respective offices.
Kasaine was in April charged with awarding a Sh84.7 million fuel tender to a company he owns, Oryx Service Station.
The governor was also charged with conspiracy to commit economic crime and failing to disclose his interest in the said contract.
“The governor failed and or neglected to disclose his interest in the said Service Station. It is clear that the governor engaged in conduct that is expressly prohibited in law and in clear violation of the constitutional principles governing the conduct of state officers,” the Director of Public Prosecution, Noordin Haji said in a statement.
Kasaine denied the charges and was released on a Sh150 million bond with a similar surety or a Sh100 million cash bail.
