Confusion is evident in Kiambu County after Governor Ferdinand Waititu’s lawyer, Tom Ojienda, said he can conduct his duties as a governor from anywhere.
“The court only barred him from accessing his office, not from carrying out his duties,” said Ojienda.
However, Justice Mumbi Ngugi said that governors should step aside once charged with criminal offences and the deputy governors to take over during the trial.
Kiambu Deputy Governor James Nyoro today said that he is ready to step in for Governor Waititu.
“We will be in office for as long as the governor is away, even if there will be an appeal on his case. The county activities must continue,” said Nyoro.
Nyoro also said that if the court dictates that Governor Waititu can come to office, he will readily vacate the gubernatorial seat.
Governor Waititu was barred from by the court from accessing his office over corrupt allegations.
Waititu and his wife Susan Wangari have been charged with six counts over a Sh588 million irregular tender.
Lawyer Ahmednassir Abdullahi has also backed Ojienda’s sentiments, saying Waititu can continue discharging his duties as a governor from any place.
“The office was not elected as the governor, it is Waititu who was elected, said Nassir.
