Lawyers of rugby players found guilty of gang-rape plead for lenient sentence

The lawyers of Frank Wanyama and Alex Olaba Mahaga, the rugby players who were found guilty of gang-rape now want the court to give them a lenient sentence.

According to their defense lawyers, there are some issues which the judge should put into consideration before giving a ruling.

Citing their age, their lawyers claim the lady who was raped had a higher mental capacity than the men.

“The accused were 22 and 23 years while the lady was 24 at the time. Therefore in mental capacity she was elder than them,” said the defense lawyer.

The defense lawyer also said the lack of injury marks on the complainants body could allude the sex was consensual.

“The accused persons are people of statue for they have represented Kenya in different statures and are required to carry themselves with dignity,” the complainants lawyer said in defense.

The Sexual Offenses Act of 2006 stipulates that the two be jailed for not less than 15 years or even a lifetime.

The complainant accused the two rugby players of raping her overnight on her birthday, February 10, 2018 at Seefa Apartments.

The lady got pregnant after the ordeal, which is said to have pushed her to make the matter public and seek justice. This is even after the rugby players allegedly threatened to sue her if she went public.
