15 police officers to be charged for teargassing, assaulting family in Busia

Twenty-one police officers will be charged in court in connection with an incident where a family and neighbours in Nambale town, Busia County, were seriously assaulted.

The 15 police officers and six county enforcement officers are accused that on March 30, 2020, they lobbied teargas into a private home, before assaulting the owner, his wife and children and thereafter neighbours who came to intervene.

DCI says that these officers were assigned police duties on the fateful day and therefore should face charges.

The charges include assault causing actual bodily harm, malicious damage to property and attempting to injure by an explosive substance.

“The ward commander who led the operation will also be charged with the additional offence of negligence in the discharge of official duty,” reads a statement from IPOA.

The officers will be arraigned on 1st February where they are expected to take a plea.

The National Police Service Act states that a police officer shall always attempt to use non-violent means first in any situation at hand.

Apparently, the said officers resorted to using excessive force in a situation where it does not warrant.
