Two police officers have been found guilty of manslaughter in the killing of a businesswoman Janet Waiyaki at City Park two years ago.
High Court judge Stella Mutuku convicted constables William Chirchir and Godfrey Kirui. Waiyaki, 41, was shot dead on May 20, 2018.
Benard Chege, 26, a relative who was with Waiyaki inside their Toyota Fielder car sustained serious gunshot injuries. The court heard that 15 bullets were fired into the vehicle.
Chirchir was an Administration Police officer attached to Makadara Police Station while Kirui worked at the Industrial Area Police Station.
Justice Mutuku ruled Waiyaki had committed no offence and alongside Chege, posed no threat to the police officers.
“They behaved rashly and opened fire with the intent to kill. All of the officers were armed, and they should have behaved cautiously. I believe there were other ways to intercept the car, and they also broke the law requiring them to protect life,” ruled Justice Mutuku.
