Charges against former Cabinet Secretary Henry Rotich, who is accused of misappropriation of public funds relating to the construction of Arror and Kimwarer Multipurpose Development Dam Projects, have not been dropped.
While dismissing reports appearing in a local daily on Friday, July 16, the Office of the Director of Public Prosecutions (ODPP) affirmed that the case against Rotich and four others are still pending in court.
Rotich and his co-accused have been charged with various offences ranging from conspiracy to defraud, abuse of office and failure to comply with sections of the law while executing contracts that bound government to pay approximately KSh63 billion for the construction of the two dams.
According to the ODPP, when the matter came up for plea on May 26 2021, the ex-Treasury CS refused to take plea on two out of the 20 counts arguing that they did not specify what particulars he [Rotich] was to respond to. The contentious counts touched on the Anti-Corruption and Economic Crimes Act and the Public Finance Management Act.
“In a ruling dated 15th July 2021, Justice Douglas Ogoti allowed the application by the prosecution to amend the charges within seven days. The cases are still pending before court,” says the ODPP.
