Four sentenced to death for robbery with violence

A court in Kirinyaga County has sentenced four men to death for robbery with violence.

Isaak Kariuki, Ndambiri, Kennedy Gachoki Kanguru, James Gitonga Wawira and Christopher Bundi Mbogo killed two people and maimed two others in the July 1, 2018 robbery at Ndindiruku village, Mwea East sub-County.

Jointly charged with others not before court, the four, armed with AK 47 rifles, robbed Margaret Wanjiku Mwangi of KSh200,000. Wanjiku and another person identified as Stephen Muriithi Mwangi were killed in the incident.

The court heard that during the incident, the gang shot and maimed James Kimani and Kelly Nyawira. They were left incapacitated, an unable to fend for themselves. Robert Mwangi, Margaret’s husband was left devastated as his liquor business went under.

Mwangi who was present in court during the ruling said the Hammurabi’s Code of an-eye-for-an eye was appropriate recompense.

Defense counsel Nduku Njuki maintained his clients’ innocence, saying police were yet to arrest and charge the real perpetrators.

Senior Principal Magistrate Gerald Mutiso said the prosecution had proven its case. He added that the four had not shown any remorse in spite of the overwhelming evidence. “The accused’s blatant disregard for other people’s lives aggravates the circumstances,” said Mutiso. “If the accused did not respect other people’s lives, we should not respect theirs either.”

They were given 14 days to appeal.
