- A father of eight is accused of using traditional brew (Mnazi) nnd cigars to lure his daughter into defiling her.
- “Spermatozoa were found in her vagina, her innerwear was soiled and wet and her hymen had been broken with the medical report confirming that it was not the first time she was defiled,” a medical practitioner informed the court.
The Mpeketoni Law Court on Friday heard how a minor was defiled by her father after making merry with traditional brews (mnazi) and cigars.
Appearing before Mpeketoni Resident Magistrate Pascal Nabwana, the minor told the court that his biological father would take her to a local traditional brew den where he would force her to drink palm wine (popularly known as Mnazi) and smoke cigars.
In her sworn testimony, the eight-year-old girl alleges that the father, John Gichuki, would then take her home, undress her and defile her.
“After taking me to the Mnazi dens, and getting me drunk he would bring me back to his house, l used to resist going into his house, but he would turn to be violent and drag me after informing his friends that he was taking me back home to my mother’s house,” the minor claims.
On the alleged day that the father of eight was caught in the act inside his bedroom, the mother of the girl had visited the husband’s house to know about the whereabouts of his daughter.
According to the testimony, upon approaching the house, the mother overheard the suspect telling his daughter, “Ukianza kuskia uchungu useme…(In case you start feeling pain let me know.)”
She immediately raised alarm with neighbours responding. They forcefully gained entry into the house by breaking the window to the suspect’s bedroom, finding him naked with the minor.
Defiled on Every Visit
Also testifying before the court was Musyoki Kisilo, a clinical officer at Mpeketoni sub-County Hospital. He informed the court that the minor had a history of being defiled whenever she visits her father.
“Spermatozoa were found in her vagina, her innerwear was soiled and wet and her hymen had been broken with the medical report confirming that it was not the first time she was defiled,” Kisilo said.
The magistrate and his court assistant could not help but burst into tears upon hearing the testimonies.
According to the charge sheet, the suspect is accused that on May 31, 2021 at Tewe area of Mpeketoni in Lamu West sub-County he intentionally and unlawfully defiled a child aged 8 years.
